During separation and divorce, emotions run high. The process of dealing with family law issues can be bewildering, confusing and traumatic. You may not be able to avoid conflict at this difficult time. However, you can choose how to manage conflict with your partner.

The traditional court approach to family law issues can be emotionally painful (not only for the separating or divorcing couple, but also for their children) as well as financially exhausting. There are alternatives. You can chose to resolve family law conflict in a principled, respectful and dignified manner.

Collaborative Family Law and mediation are problem-solving processes that allow active participation in, and control over the decisions about your family's future after separation and divorce.

Family Law Solutions offers a No-Cost, No-Obligation initial consultation. We will sit down with you, listen to your needs and concerns and explain the processes available to address your particular situation.

You might choose:

1. Collaborative Family Law (CFL):

This is a cooperative, private, problem-solving process. Each party is represented by his or her own specially-trained CFL lawyer, but the parties and their lawyers commit in writing to work as a team to solve the family's legal problems. The approach is gentler on the parties. The emphasis is on designing a settlement that meets the family's needs and on preserving their future relationships. The process is honest and open. Negotiations are conducted in four-way conferences, in a ‘round-table' format and in an atmosphere of cooperation and good-faith. Important information is shared voluntarily. Nothing is done in secret and no one even threatens court action. The only agenda is resolution. The parties confirm their joint decisions in a Separation Agreement.

2. Mediation:

This is also a cooperative approach to family law issues. One neutral mediator works with the parties directly to help them achieve consensus. The mediator does not provide legal advice to either party and does not make any decisions for them. The mediator prepares a Memorandum of Understanding, a written account of the parties' agreement. This written document provides the framework for a Separation Agreement prepared by the parties' lawyers.

3. Litigation:

This is a contested, public process designed to determine issues in Family Court. The parties are adversaries. Their lawyers are advocates for their respective positions. The parties themselves participate in the court process in a limited way. Ultimately, a judge makes decisions about the custody, access, support and property division issues and these are incorporated into temporary and final Orders. The parties must comply with the terms imposed or face further litigation and sanctions.
